February 9, 1999

On this day in 1999, Dave Grohl, Roswell Records -owned by Grohl, EMI Entertainment World and EMI Virgin Songs filed a lawsuit against Miramax -owned by Disney, accusing them of using 18 seconds of unauthorized use of the Foo Fighters’ song “Big Me” in trailers for the Matt Damon film Rounders.

Grohl claimed that the band originally agreed to a proposal from Miramax to use 15 seconds of the song, but the studio never signed a contract with Miramax nor received any pay. The track was used anyhow.

Foo Fighters asked for $86,000 in compensation, as well as all videocassettes containing the trailer on it to be recalled.
